Absolutely. The board is accountable for oversight of the CEO and was complicit in what was happening. They may say that they didn’t know the details but if they saw a sudden jump in profits due to introduction of the flawed AI they had the obligation to challenge the executive team as to its origin and whether it was done ethically or not (ie “oh you saw that this profit is due to the introduction of AI but are you tracking how many of the denied requests were legitimate or not?”)
Society needs to learn to hold board members accountable as well
