DENVER (AP) — A divided Colorado Supreme Court on Tuesday declared former President Donald Trump ineligible for the White House under the U.S. Constitution’s insurrection clause and removed him from the state’s presidential primary ballot, setting up a likely showdown in the nation’s highest court to decide whether the front-runner for the GOP nomination can remain in the race.

It’s not just about whether this is a political treat, it’s about the legitimacy of the US constitution.

Imagine if the Colorado Supreme Court decided not to pursue this because it would be more politically convenient not to give Trump the opportunity to play the victim. In the short term, sure maybe that’s what keeps Trump out of the office. In the long term, insurrection is no longer off the table for any political opponent who loses an election. Why persecute any criminal when it’s politically inconvenient anymore?

Not to mention Colorado is just the beginning.
