Sounds like a hate crime.
Depending on what else is done, quite possibly. Alone though… apparently even burning the US Flag is currently speech that is protected by the US Constitution, according to the Supreme Court.
The ACLU might take that as one of those rare occasions that they support the reds.
Concerning hate crimes in America, US Citizens (and US flags) are not a protected class. But, I agree with you. Solely burning any flag is probably protected by 1A, as long as that is all that is happening, and the flag belongs to the person burning it.
I would argue that if a bigot came on my porch and took down my pride flag and then burned it, that it is a hate crime.
This is as edgy as I’d ever want to get, but does this mean that we need to burn the US flag to get human rights? I guess equal justice would be to burn the Colorado Republican Party flag.
