Something I’ve wondered about since that ruling came out, given that they didn’t really specify what acts were official ones, is if another court could effectively render that ruling meaningless, by ruling something to the effect of “Only acts that do not violate any laws are considered to be official acts”
“bUt MuH uNiTaRy ExEcUtIvE tHeOrY!!!”
-some federalist society weirdo.
It would likely head back to the supreme court to decide.
Okay, I legitimately and seriously need to ask how.
How can a circuit court override a Supreme Court decision?
Issue a contradicting ruling and pray to jebus it sticks through appeals.
This is something that usually happens with intervening decades of political shifts though, so this is basically the courts potentially immediately recognizing “ok yeah no we fucked up on that one, Soz y’all!”
