      They don’t really get a choice. The only thing they get to do is say yes the votes counted up the way or no they didn’t. It isn’t like Congress gets to just decide

      Meh fuck it we won’t certify. Even if they did. Then it goes to the courts (regardless of who the justices are or who put them there, the courts will order Congress to certify the election)

      VP doesn’t have that power. Republicans were hoping Pence would do it anyway and then battle would go to courts and conservative SCROTUS would agree.

      Until 2021 that date had no special meaning and it was just mostly ceremonial.
