Saw this on bluesky and thought I’d share here since I think there’s a lot of trans folks trying to find ways out of the US and this could potentially help in the future.

    This is unfortunately not at all how the laws work in Canada. We tried this so many times but we have a safe 3rd country agreement with the US so it just gets shot down.

    Also people in Canada aren’t all that much more friendly to us.

      Imo, sure it’s very very unlikely to have anything happen. But if there’s even a small chance we should continue trying. I don’t think it’s impossible for a politicians understand that people want something via a petition like this and offer a modified bill that has concessions so it doesn’t fck with any agreements we have with the US but still support trans 'refugees".

      Also it’s not really about being friendly it’s more just that if shit does hit the fan and everything planned in the executive orders happens folks have a place to escape to even if it’s not perfect. Since those kinda anti human rights laws are a lot harder to do in Canada then the US.

        Sure I am not knocking the attempt as a matter of principle.

        However, you are plainly wrong about the Canadian constitution if you think it’s safer. Look into the notwithstanding clause.

        All a politician needs to do in order to genocide us with explicitly transphobic legislation is invoke the notwithstanding clause.

        And Pierre Poilievre has said he will do so in order to add new criminal offences to the law that violate human rights. His party’s platform is also looking like it will win a majority and the platform includes banning trans women from female spaces at the federal level (something that can only be done via the criminal code thanks to separation of powers in our constitution).

        They explicitly don’t even need a state of emergency or any reason at all to do so. They just need to do it & it overrides all of section 15 charter rights which means all of our rights to be free from discrimination on the basis of trans status.

        Totally legal in Canadas constitution and would likely be upheld by the Supreme Court. It’s a massive hole in our country’s legal system.

        Not trying to be discouraging here. Just FYI I live in Canada and am beginning to assess my own options for leaving if needed. India and Thailand are looking pretty good. EU, NZ, and AUS maybe.

    I am sure that the orange faced turd will go far enough that any lgbt will be in a situation to seek asylum in Canada or Europe… and it is sad and I feel deeply sorry for them

      I’ve joked with European friends about how far does the US have to fall before I can claim refugee status. It feels bittersweet to see the joke become a real question.
