First release of the Dark Souls 3 Seamless Co-op mod, from the same person who brought us Elden Ring Seamless Co-op. They are considering this an alpha release so expect breakage!
Do you need an “illegitimate” copy of the game for such a mod to work or does a legit copy off Steam, for example, work too?
It actually only works with the legit Steam copy.
How do they enforce it?
I didn’t check since I have the game on Steam but it says on the mod page that it needs the Steam version in online mode.
The mod doesn’t do any enforcement itself. It uses Steam matchmaking so your account will need to be online with good VAC standing.
In the mod description the author specifically calls out pirated versions and says they will not put any effort into making it work. I can only assume how many times they were asked the same question before adding that disclaimer.

I’m not sure what you mean? There’s a whole section for configuring scaling in the
ersc_settings.ini
file. Health, damage, and posture scaling % per-player are configurable for enemies and bosses separately.Oh neat, I’m glad they finally added that. When I played a few years ago, there wasn’t any config file. So things like the rot mechanic and the broken* default boss scaling were forced upon the players.
*Enemy health and resistances would both be scaled, so 3 players would make the enemies 9 times harder instead of 3 times harder. We had to have one friend bring in their smurf character, and even then we struggled on the basic enemies in the Golden City.
