    So maybe I’m just stupid but, couldn’t they already arrest people entering the US illegally considering it is, ya know, illegal? This just seems like posturing by abbot.

      They don’t have jurisdiction and the State can’t suddenly grant it.

      Section 439 of the Antiterrorism and Effective Death Penalty Act of 1996 added a new 8 U.S.C. § 1252c which provides that notwithstanding any other provision of law, to the extent permitted by relevant State and local law, State and local law enforcement officials are authorized to arrest and detain an individual who (1) is an alien illegally present in the United States; and (2) has previously been convicted of a felony in the United States and deported and left the United States after such conviction, but only after the State or local law enforcement officials obtain appropriate confirmation from the Immigration and Naturalization Service of the status of such individual and only for such period of time as may be required for the Service to take the individual into federal custody for purposes of deporting or removing the alien from the United States.

      This violates federal law because they are arresting at will.

      This sounds like a “papers, please” facism move that makes “being brown” probable cause. Not like the cops needed much of a reason, but any excuse they can give to empower a police state is a dream to them.

        They already had profiling stops. Heading north on a highway near Las Cruces everyone was stopped. Half the time they didn’t even check our IDs, just looked at all of our white faces and let us go.

      Only the federal government can determine whether or not the immigration is illegal.

      For example, seeking asylum is legal immigration and there is no requirement for an asylum seeker to cross at an official port of entry.

      Only the federal government has the right to evaluate asylum applications, so by trying to bypass the federal government, this law is effectively an attempt by the state government to deny people the right to seek asylum.
