The woman told a sheriff’s lieutenant in an interview that she filled out her mother’s ballot after her mother’s death, according to a probable cause statement filed with the district court. The statement said the woman was an “ardent” Trump supporter who had wanted to vote for him before she died.

Just make sure you don’t mail it back, the post mark might give you away.

Ok I hate to be devils advocate here but… say you are taking care of your sick and dying mother. She has a stack out outgoing mail you haven’t had a chance to drop off at the mailbox yet. It includes her mail in ballot. She dies. Then you take her last unsent mail to the mailbox. It would be post marked after her death. Is that a legit vote?

Also I happened to notice our mail in ballots say “no power of attorney” so presumably the person has to be able to fill out and sign it themselves.

This. If she voted, but it is postmarked after her death, it will probably be flagged, however, you haven’t broken the law.
