Since this decision came from a appeals court, they well might refuse to hear it.
In New York the Appeals Court is the court of last resort. You can appeal NY Supreme Court decisions to the Appeals Court, not vice-versa.
And there it is.
Funnily enough, the New York Supreme Court is the state’s trial court, not a final appellate court.
