      Do you think we might finally see support from Thomas against the conservative view on Loving or do you think he’s looking for a “pocket divorce” from his wife? “I’m sorry honey, our marriage isn’t Constitutional anymore.”

        I suspect they will clarify the decision to specifically exclude application of it to same-sex relationships, finding that “equal protection” cannot include classes created by “personal choice” such as sexual orientation or gender identity.

        You know… Standard conservative bigotry. The outright racism and re-segregation happens a couple years later, I predict.

          I’ve said it before and I’ll say it again: conservatives who think that sexual orientation or gender identity are choices think that because they themselves have chosen to remain in the closet. They lie to themselves and resent that other people might have an easier time than they’ve had and continue to have. I don’t care that they’re gay, but I care about hypocrisy.

            That’s possible for those conservatives that are closeted, but I think the majority of conservatives simply lack empathy on this point. They have no concept of it for themselves, so they assume everyone is like themselves.

              Empathy is the exact reason. Until they have first-hand experience with something, they will consistently stand firm on their own beliefs. Until it’s someone they know, it only affects “the wrong people.”

      Less than one percent of the cases that apply for certiorari have it granted. SCOTUS not picking up a case shouldn’t be taken as a sign of anything.
