Summary
A swath of Democratic-led states and civil rights groups have filed the first lawsuits challenging executive orders Donald Trump signed after taking office, including one that seeks to roll back birthright citizenship in the US.
A coalition of 18 Democratic-led states along with the District of Columbia and the city of San Francisco filed a lawsuit in federal court in Boston on Tuesday arguing the Republican president’s effort to end birthright citizenship is a flagrant violation of the US constitution.
That lawsuit followed a pair of similar cases filed by the American Civil Liberties Union, immigrant organizations and an expectant mother in the hours after Trump signed the executive order, marking the first major litigation challenging parts of his agenda since he took office.
Edit: Count is now 22 states. Thanks empireoflove2!
Yeah good luck with suing someone who uses law books for toilet paper…I’m sure trump is very worried now.
Why do we have to sue to have our founding document respected?
Because it’s all you can do. However, this will almost certainly go all the way to the corrupt supreme court, who will find in favour of trump, and change the constitution.
At that point I hope the blue states realize there’s nothing to gain from remaining in the union
Remember a year ago when Texas was talking about seceding, and how everyone pointed out that there was no legal mechanism for them to do that ?
I remember reading in school about how the American colonies lawfully seceded from England. It was all done according to the letter of the law, with a lot of respect from both sides on how cordial the whole process was.
Given the fact that Texas will threaten to secede at the drop of a hat and have been doing so since they lost in the civil war. Well it comes across as hollow and annoying at best.
If laws don’t matter, neither does a legal mechanism.
Yeah, we’re starting to learn that a lot of “rules” aren’t actually written down, and even if they are, who cares if they aren’t enforced? The Trump era will teach an entire generation of Americans that lawlessness is subjective and always profitable.
There’s never a legal way to overthrow a corrupt government. The US didn’t gain its independence from England through legal channels.
Yup.
Take our massive economies and our larger number of military personnel and do our own thing. Not much of a loss.
Yup.
And you can 100% expect them to try to use the Supreme Court to amend the constitution to keep Trump (or his unelected successor) in power at the end of this 4 year stretch. That or they’ll declare some state of emergency and “postpone” elections.
This is anti-democratic felon rapist whose party has enabled him every step of the way and already removed women’s rights. They will absolutely attempt what I just described.
Because Republicans spent years radicalizing the dumbest members of our society, which unfortunately now include over half of voting Americans, using fear-based propaganda, in order to put themselves in a position to dismantle our democracy for their own benefit.
Because half of all people are dumber than average.
No, half of all people are dumber than the mean.
What else do you expect? Trump struck down by lightning as soon as he signed it?
Because it was intentionally written to be vague in places. As time passes, and sensibilities change; This allows current people to debate and reinterpret what those passages mean for them.
Republicans don’t want to respect 14th amendment, Democrats don’t want to respect 2nd amendment.
Yes, Remember when that Democratic president signed an executive order banning guns?
Yes, Bill Clinton.
It’s in the Democratic party platform, “ban assault weapons.” 90% of their party platform is fine but I don’t agree with that part. https://democrats.org/wp-content/uploads/2024/09/2024_Democratic_Party_Platform_8a2cf8.pdf
And they signed an executive order to do so?
The Constitution can be changed, we are talking about amendments afterall, but there are specific methods of doing so. None of those methods involve a King declaring it so.
I wish that were true, maybe all those school shootings would stop if we actually did something about them
That’s how government works.
This is just the beginning of the Trump Party (not Republican Party anymore) attempting to dismantle our Constitution.
Expect it to continue non-stop for the next 4 years minimum. And expect it to succeed in some ways. We will not come out of this era with the same number of rights we went in with. Women already haven’t.
Not even half the states
yeah this isn’t enough of the states
Just the states with a population bigger than like east LA or the Bronx.
we havin fun yet?
More “fun” than has ever been seen in the history of the USA. Many very important people are saying this is the most fun that has ever been had.
Oh no, you still aren’t at 1861-65 levels of fun. For now.
Article has updated since posting. It’s now 22 states.
I have the following count from what I could gather, if you’re not in one of these states/jurisdictions and you are in the United States, I would encourage you contact your local state attorney general and encourage them to take part.

Glad I am in Oregon then. I might have a chance of retaining some semblance of human rights
Is this one of those things that will end up at the Supreme Court? If so, I don’t have much faith and would sound like exactly what they want to occur.
What’s the alternative? Not resist, throw our hands up, and say “it won’t work”? These fascist bootlickers can destroy our democracy, but we don’t have to make it easy for them…
Americans won’t do anything until it personally affects their lifestyles. So, probably not at all, and if so, probably far too late.
I’m curious to see a map of cannabis legalization map next to a map of these States.
